Main licence conditions
For all applications
By downloading or paying for any version of any Sevit’s application – paid (regardless of the method of payment) or free of charge you confirm that you have read and understood the documents presented on this page, understand all terms, rules and restrictions described there and agree with them.
The licence gives the right to free updates of all “intermediate” versions (vY.x, vY. (X + 1), etc.) until the next “big” version of the program – v (Y + 1) .0
For applications in SPSM family
Only one database per licence is allowed. There is no limitations on the validity period, the number of users, the number of copies, the number of seats, the number of records in the database, etc.
For SCS application
Only one seat per licence (each computer\copy requires separate licence).
Return Policy
Sevit Inc. will accept returns of packaged software within 14 days of purchase in an unopened packaging only.
Software purchased on-line through sevit.ca or any other website is considered opened at the time of purchase. There are demo and free versions of our software available to anyone interested on download page of the web site. This allows all prospective buyers to evaluate products without any time limits to ensure that the software meets their needs before purchasing.
The are absolutely no refunds of returns on opened software.
Software that has been opened or purchased on-line is provided with technical support, depending of the purchased option. For more information on technical support options, please visit support option page on company’s web site.
Privacy Policy
Collection of Information
Sevit Inc. collects the following information from it’s clients:
– For the purpose of issuing software license : business’s name and business’s taxpayer’s number (INN in Russia);
– For billing purposes : Payer’s information, depending on the chosen way of payment, one or more of the name, billing address, phone number, credit card number, credit card expiration date, credit card verification code, bank account number, bank branch address, bank branch routing number;
– For the purpose of sending license file : e-mail address.
Above information is only used to complete the sale transaction and issue the license, unless customer gives Sevit Inc. permission to use it in another manner, for example to be added to one of company’s mailing lists.
Distribution of Information
Sevit Inc. may share information with governmental agencies or other companies involved in fraud prevention or investigation. Sevit Inc. may do so when:
– permitted or required by law;
– trying to protect against or prevent actual or potential fraud or unauthorized transactions;
– investigating fraud which has already taken place.

Client’s information is kept secure. Only authorized employees have access to this information. The information is not provided to any third parties for marketing or any other purposes.

Support for paid products
Technical support is provided from the 1st to the 90th day from the moment of purchase of the program or until the next “big” version of the program (5.0, 6.0, 7.0, etc.) is released:

Support terms and conditions
Database support is provided only for issues directly related to the operation of Sevit Inc. programs.
Recovering data lost due to the fall of the client server (physical failure of the hard drive on the client server, accidental deletion of database files from the client server, etc.) is not included in the support.
The support service does not provide any advice on installing and configuring any programs other than Sevit Inc. programs.
If necessary, the client undertakes to send by e-mail, upload to / give access to download from FTP or otherwise transfer database files to the support service. Support will not disclosure any information from the client database to any third parties.

Software named Sevit Print Shop Manager, Sevit Print Shop Manager Lite, Sevit Print Shop Manager Digi, Sevit Print Shop Manager Free, Sevit Print Shop Manager Wide, Sevit Communication Server, SPSM, SPSM Extra, SPSM Lite , SPSM Digi, SPSM Wide, SCS or SPSM Free that is sold trough or made available to download from this web site is the copyrighted work of Sevit Inc.
Use of the Software is governed by the terms of the End User License Agreement which is included with the Software. An end user will be unable to install any Software that includes a End-User License Agreement, unless he or she first agrees to the End User License Agreement agreement terms.
The software is sold or made available for downloading solely for use by end users according to the End-User License Agreement. Any reproduction or redistribution of the software not in accordance with the End-User License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
The software is warranted, if at all, only according to the terms of the End-User License Agreement. End User Agreement
Please read this agreement carefully before using Sevit Print Shop Manager or Sevit Communication Server.
By installing and using our software, you acknowledge that you have read this agreement, understand it and agree to be bound by its terms and conditions.
This Sevit Print Shop Manager and Sevit Communication Server End-User License Agreement (“Agreement”) is a legal agreement between you (either an individual or a single entity known as “Customer”) and Sevit Inc., which owns a proprietary computer software (collectively known as “Sevit Print Shop Manager” or “SPSM” or “Sevit Communication Server” or “SCS” or “Software” .
By installing or otherwise using the Software or any Software Updates,Customer agrees to be bound by the terms of this Agreement. If Customer does not agree to the terms of this Agreement, do not install or use the Software, including all Software Updates (each of them known as “Update”) that Customer received as part of the Software .
By installing or otherwise using an Update, Customer agrees to be bound by the additional license terms that accompany such Update. If Customer does not agree to the terms of the additional license terms that accompany the Update, disregard the Update and the additional license terms that accompany the Update. In this event, Customer’s rights to use the Software shall continue to be governed by the then-existing Agreement.
Copyright
All title and copyrights in and to the Software (including but not limited to any software components, product documentation and associated media, sample files, extension files, tools and utilities, miscellaneous technical information, collectively referred to herein as the “Software”), and any copies of the Software, are owned by Sevit Inc. The Software is protected by Canada copyright laws and international treaty provisions.
Therefore, you must treat the Software like any other copyrighted material, except that Customer may either (i) make one copy of the Software solely for backup or archival purposes,provided Customer reproduces and includes Sevit Inc.’s copyright and trademark notices contained on the original package on such backup copy, or (ii) transfer the Software to a hard disk, provided Customer keeps the original solely for backup and archival purposes. The Software is licensed, not sold.
Grant of License
a. Sevit Inc. grants Customer a non-exclusive license to use the SPSM or SCS computer software. Beyond the right to use the Software, this license also entitles the Customer to free support up to 90 days from the day of purchase and “minor” version product upgrades for purchased “major” version. These additional benefits are time limited and subject to the maintenance plan purchased or included in the license, according to support conditions, described on product web site.
b. SPSM or SCS software shall be deemed accepted by Customer upon payment for the Software by Customer.
c. The software is licensed, not sold.
Other Restrictions
a. The Software is the sole and exclusive property of Sevit Inc.,including all applicable rights to patents, copyrights, trademarks and trade secrets and is provided for Customer’s exclusive use for the purposes of this Agreement and will be held in confidence.
b. Customer will not remove any designation mark from any supplied material that identifies such material as belonging to or developed by Sevit Inc. Customer agrees not to disassemble, decompile, reverse engineer or otherwise reduce the Software to perceptible form.
c. Customer may not rent, lease, sub license or otherwise distribute the Software.
d. Customer may not install and run the Software from a network server or any computer, where it can be accessed by anyone, who is not Customer’s employee. License is bounded to a Customer, based on a combination of name and INN (taxpayer’s number). No other companies, with different name and\or INN or individuals may use the software under the Customer’s license.
e. We cannot guarantee that the Software will work for all times. If you change your operating system, the software may not work anymore.
f. All title and intellectual property rights in and to the content which may be accessed through use of the Software are the property of the respective content
owner and may be protected by applicable copyright or other intellectual property laws and treaties. This Agreement grants you no rights to use such content.
g. Customer must make sure that it is legal to use the software in Customer’s country or jurisdiction with the supported features. Sevit Inc. only provides a license to the software. It’s the customers responsibility to make sure that Customer is allowed to use the software.
h. All trademarks are owned by their respective holders.
Termination
Without prejudice to any other rights, Sevit Inc. may terminate this Agreement if Customer fails to comply with the terms and conditions of this Agreement. In such event, Customer must destroy all copies of the Software in any form and all of its component parts.
Disclaimer of Warranty
a. NO WARRANTIES. THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Sevit Inc. DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY AGAINST INFRINGEMENT, WITH REGARD TO THE SOFTWARE. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION.
b. NO LIABILITY FOR DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Sevit Inc. BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF Sevit Inc. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
c. Sevit Inc. SHALL BE RELIEVED OF ANY AND ALL OBLIGATIONS WITH RESPECT TO THIS SECTION FOR ANY PORTIONS OF THE SOFTWARE THAT ARE REVISED, CHANGED, MODIFIED, OR MAINTAINED BY ANYONE OTHER THAN Sevit Inc.
Governing Law
This Agreement shall be construed and the legal relation between the parties determined in accordance with Canada law.
CUSTOMER ACKNOWLEDGES THAT CUSTOMER HAS READ THIS AGREEMENT, UNDERSTAND IT AND AGREES TO BE BOUND BY ITS TERMS AND CONDITIONS. CUSTOMER FURTHER AGREES THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN CUSTOMER AND Sevit Inc. WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN CUSTOMER AND Sevit Inc.
RELATING TO THE SOFTWARE. This Agreement may not be modified except by a writing signed by a duly authorized representative of Sevit Inc.
